Chappters® Privacy Policy

  1. Respecting your privacy

Your privacy is important to us. This privacy policy sets out how The Troublemakers Club Pty Ltd (ABN 72 655 026 850) trading as Chappters (we, us or our) collects, holds, uses and discloses personal information that you provide to us in connection with the Chappters® App (App). 

 

This policy also informs you of your rights to privacy and explains the choices you can make about the way your personal information is collected and used. 

By communicating with us, you consent to us collecting, holding, using and disclosing your personal information as set out in this policy, or as otherwise disclosed by us at the time of collection. 

 

We may update this policy from time to time, and the most current version will be made available in the App. You may be asked to accept the new policy before you can continue to use the App. If you are not asked, we will treat your continued use of the App, or your provision of further personal information to us, as your acceptance of the amended policy.

This policy should be read together with our App Terms of Use.

2. Collection of your personal information

The types of personal information that we collect and hold about you will depend on our relationship with you and the circumstances of collection.  

Generally, we will only collect personal information from you:

  • when you make an enquiry or provide feedback to us; or

  • when you otherwise communicate with us.  

The only personal information that we collect and hold about you when you contact us is what you tell us about yourself, or information you provide to us.  The types of personal information that we may collect includes your name, contact details (such as your mobile phone number and email address), any other information you provide to us, and your feedback and opinions. 

 

In most cases, we will only collect personal information directly from you.  However, in certain cases, we may also collect personal information from a third party or from a publicly available source, but only if you have consented to your information being used in this way, or would reasonably expect us to collect it in this way. We only collect this information from companies or sources that are allowed to disclose it to us. 

 

We will not collect any personal information from you:

  • when you install the App; or

  • when you use the App, except as set out in this policy.  Please note that the App uses and stores data and content (including your User Content) in your iCloud account linked to your Apple ID, which we cannot view or access. 

3. Providing personal information about others

You must not provide us with personal information about any other individual unless you have the express consent of that individual to do so. If you do provide us with such information, before doing so, you:

  • must tell that individual that you will be providing their information to us and that we will handle their information in accordance with this privacy policy; 

  • must refer that individual to this privacy policy; and

  • warrant that you have that individual’s consent to provide their information to us.

4. Use of your personal information 

We use the personal information we collect for the purposes for which it is collected and for other related purposes, and as permitted or required by law. Our general purposes may include:

  • to verify your identity;

  • to respond to your enquiries or requests for assistance from us;

  • to improve and develop the App, including expanding the functionality and offerings available through the App; or

  • otherwise to facilitate our business operations and processes.

5. Disclosure of your personal information

Generally, we will obtain consent before we disclose any personal information to third parties. Such consent may be given expressly or it may be implied by conduct.

We reserve the right to disclose any personal information to law enforcement or other government officials where such disclosure is required by law, or where we reasonably believe that disclosure is necessary or appropriate. 

We will never sell, trade, lease or rent your personal information to third parties. 

We may share de-identified, aggregated information with third parties for their marketing purposes, but such information will not individually identify you. 

6. What happens if I do not provide personal information?

If you do not provide your personal information to us, we may not be able to respond to your enquiry or provide assistance to you. 

7. Cookies 

We may also collect data from you by using ‘cookies’, which are small data files deposited by the App on your phone, computer, or other device, that allow us to track your use of the App. Cookies are sent back only to the servers that deposited them when a visitor returns to the relevant page/app. 

With the information we receive through cookie technology, we hope to improve the App.  In addition, we may gather information about you that is automatically collected by our server, such as your IP address and domain name. We may use this information to customise our offerings, to make information more readily accessible to you, and to make the App easier for you to use. 

Cookies can be accepted or disabled at your preference. If you disable the use of cookies,  please bear in mind that this may affect how some items are displayed in the App.

8. Location data

We may identify and use location data sent from your device. You can turn off this functionality on the device by turning off the location services settings for the App. If you do not turn off the location services, you consent to us collecting, transmitting, processing and using your location data to provide and improve location-based services. You may withdraw this consent by turning off the location services settings at any time. 

9. Data security

We take the security of your personal information seriously. We take reasonable steps to protect the personal information we hold, whether in electronic or other form, against loss, unauthorised access, use, modification or disclosure, and against other misuse. 

When no longer required by us or when requested by you, we will take reasonable steps to destroy, delete or permanently de-identify personal information in a secure manner.

10. Access and correction

You may request access to the personal information we hold about you by contacting us using the contact details below. We will process such requests within a reasonable time. If we deny an access request as permitted or required by law, we will provide reasons to the extent we are required to do so.

We will take reasonable steps to ensure the personal information we hold about you is up to date and accurate. Please let us know promptly if any changes are required to be made to the personal information we hold about you by contacting us using the contact details below. 

You may ask us at any time to correct personal information we hold about you. On request, we will take reasonable steps to correct the information so that it is accurate, complete and up to date, or will provide reasons for not doing so to the extent required.

11. Complaints handling

If you wish to make a complaint about a breach of this policy or the Australian Privacy Principles, you can contact us using the contact details below. You will need to provide sufficient details regarding your complaint, together with supporting evidence and information. We will investigate your complaint and determine what steps we need to take to resolve your complaint. We will contact you if we require further information from you, and will notify you in writing of the outcome of our investigation. 

If you are not satisfied with our determination, you can contact us to discuss your concerns or contact the Australian Privacy Commissioner through its website at www.oaic.gov.au.
